Terms and Conditions & Terms of Use1. Corporate Purpose, No Entitlement to Use1. Residenzo allows time limited ads to be placed for letting or exchanging holiday houses, apartments and similar properties . The ads appear on residenzo’s webpages and can be viewed by all visitors to residenzo’s webpages cost-free and without registering. Furthermore, interested parties can contact the Advertiser cost-free and commitment-free by using our special contact form. Contracts between advertisers and interested parties are not concluded on the residenzo webpages. 2. Residenzo does not place ads in its own name or that of another, nor on its own account or that of another, and it has no commercial or legal involvement of a direct or indirect nature with the contractual relations between the interested party and the Advertiser. No contractual relations exist between residenzo and the Advertiser apart from those relating to the publication of ads and it receives no commission or similar benefit for the successful outcome of a contract between the Advertiser and the interested party. 3. There is no legal entitlement to use residenzo pages. 2. Purpose of the ad 1. Ads can only offer holiday homes, appartments or similar properties for renting to or exchanging with private persons (offer ads). Ads that advertise for these kind of properties (want ads) and especially ads which are aimed at the purchase or sale of a property or of rights to property, are not permitted. 2. The same property can only be entered once at any given time. 3. Form and Placement of Ads 1. The size, shape, colour, resolution, layout etc of your ad is determined exclusively by residenzo. There is no legal entitlement to a particular presentation. The Advertiser agrees that his or her ads will be presented in the usual form that residenzo determines and residenzo reserves the right in particular to enlarge or reduce photos to ensure a standardized and comprehensible presentation. 2. The placement of ads on the pages is decided exclusively by residenzo. There is no legal entitlement to a particular placement. residenzo reserves the right to change the placement of a published ad, when this is in the interests of ensuring the property is easily understood and clear. 4. Content of ads, compatibility with the applicable law, third party rights 1. Residenzo has sole right of approval of the content of ads. Ads that do not meet the requirements set by residenzo will not be accepted or published. 2. Ads must contain only the following content: - Images, Photos, Cards - Information about the Size and Situation of the Property. - Information about Furnishings, - Information about Rate, - Information about Availability, 3. The following content in particular is unacceptable: - banned or unsuitable content 4. The Advertiser undertakes to ensure that the publication and use of his or her data by residenzo and all the contents provided by him or her is in accordance with the applicable law and that he or her disposes freely of the information provided and that it is not burdened with third party rights. 5. Function of Ads 1. The Advertiser must be registered with residenzo. Registration is cost-free and can only be done via the standard electronic registration form provided by residenzo. When registering, the Advertiser must provide complete and correct details for first name, second name, company, postal address (no P.O boxes), tel. and FAX numbers and a valid email address. If the details that were provided at Registration are changed at a later date, the Advertiser undertakes to notify residenzo of all changes immediately. 2. The licence agreement between residenzo and the Advertiser comes into effect only after the registration has been confirmed by residenzo. 3. After registering, the Advertiser can place ads with residenzo. 6. Rejection, Change, Deletion, Exclusion Residenzo reserves the right to alter or to delete in their entirety ads which contravene the applicable law or our own Terms of Use. In this event the Advertiser can be permanently or temporarily barred from using the residenzo webpages. 7. Contractual Services, Liability and Warranty 1. The contractual task of residenzo consists on the one hand of setting up the technical platform for presenting ads on residenzo. On the other hand, residenzo offers interested parties the opportunity to make contact with Advertisers by using a contact form, and conveys information about the interested party directly to the Advertiser. residenzo does not mediate any contractual agreements between the Advertiser and the interested party. 2. All the data about properties including all photos of the properties and all other information concerning theses properties are based exclusively on statements by the Advertiser and cannot be checked by residenzo. Consequently, residenzo accepts no liability for the content of the advertisement, nor for ensuring that it is up to date, accurate and complete. 3. Residenzo is not responsible for damage which results from the incorrect presentation of ads or non-presentation. The only exception is malicious intent or gross negligence on the part of residenzo or its vicarious agents. 4. Residenzo is not liable for infringements of copyright and performance protection by third parties.. The Advertiser releases residenzo from all claims raised against residenzo. This relates to infringement of copyright or performance rights by the publication of content by the Advertiser. 5. All personal details about interested parties that residenzo provides are derived exclusively from these people. residenzo can neither check the identity of interested parties or their details for accuracy and completeness. The possibility cannot be excluded that interested parties may provided false information, that they are not the person they claim to be. residenzo conveys the information exactly as provided and cannot accept liability for ensuring that its is correct and complete, not for the effects of any errors or omissions. 6. The availability and quality of the residenzo webpages depend on the technical options that are available at any given time. A guarantee with regard to a particular availability and quality is not provided. residenzo has fulfilled its contractual requirements when its pages are available for 330 days a year. 8. Revising and Updating Every website requires regular maintenance for the benefit of Internet users Consequently, residenzo reserves the right to run technical checks and update the content of its webpages on a regular basis. This process can make the residenzo webpages temporarily inaccessible, and affect the quality of the ads on them. While residenzo makes every effort to avoid these effects or to minimise them, it is unable to exclude them completely. No liability is accepted for any disadvantage resulting from this. 9. Copyright 1. Residenzo is the exclusive advertiser of all the content displayed on residenzo webpages, including the layouts and the source texts. . All reproduction, publication and dissemination or other application is only permitted following written permission from residenzo. 2. The rights of the Advertiser with regard to the contents of and information in their ads are not affected by this condition. 10. Cancellation 1. Both parties can cancel the contract at any time without providing a reason, within a time limit of seven days at the end of a given month. The cancellation may be expressed in text form (letter, FAX, or email). Jurisdiction Whether an Advertiser is a commercial person in the meaning of the German Commercial Code, a separate estate under public law or a legal person under public law, falls under the exclusive jurisdiction of Reutlingen with regard to all disputes arising out of the licence agreement. 12. Applicable Law The legislation of the German Federal Republic (BRD) applies. 13. Data Protection The Advertiser hereby agrees that all data of a personal nature will be gathered, saved and processed in compliance with the data protection rules that apply in Germany. 14. Written form clause 1. All changes and additions to these Terms of Use must be conveyed in the written form (§ 126 BGB). 2. This also applies to deviations from the requirement for the written form.
